Where is the Terms and Conditions of Use?

Since July 01st, 2024, we have been applying a revised version of the Respaid Service User Agreement and associated terms and conditions, which apply to the use of some of our products. 

The new Respaid Service User Agreement and associated terms will come into effect on July 03rd, 2024 for our users in the United States, the United Kingdom, the EEA, and France.

If you do not accept this new version, you must stop using our services and

 before it becomes effective. Your use of our products and services after this date will be subject to the new terms.

These will apply to new users as soon as they register.

If you agree to the updated conditions, no further action is necessary on your part, as this modification will not affect the existing terms.

Resuming collection efforts on the Respaid Dashboard

When you choose "Resume Collection Efforts" on the Respaid dashboard, all notes, supporting documents, and client communications must acknowledge the existence of the debt. This clarity helps maintain a smooth collection process and fosters trust with all parties involved.

To ensure successful debt recovery, all communication between the creditor and debtor should consistently affirm the debt's existence. Responses that question the nature of the debt may hinder the collection process. By maintaining clear and consistent messaging, we can work towards a positive resolution for all parties.

In cases where communication has been issued that questions the debt's validity, it may not be possible to resume collection efforts against the debtor. In such situations, the debt may need to be considered canceled. We're here to help you navigate these complex scenarios and find the best path forward.

Ensuring appropriate collection practices

Requesting to resume collection efforts with inappropriate communication is equivalent to declaring a resumption of efforts, but it won't help recover the debt or gain acknowledgment from the debtor. This approach allows us to stop unnecessary follow-ups if the debt isn't owed, or to continue collection efforts if it is. Best practices for handling disputes, document requests, and debt cancellations

Canceling a case means stopping all follow-ups with the debtor. A mass cancellation involves halting actions on all cases in a campaign.

Canceling an entire campaign is a decision made following a prior discussion between Respaid and the creditor. Our team rarely resorts to this, and the user is always informed in advance.

Below are the main reasons that can lead to a mass cancellation (non-exhaustive list):

 The creditor can submit a written request to cancel a campaign to their Respaid Account Manager, stating the reason.

 The Respaid dashboard offers the ability to edit debt/debtor details (amount, contact information). However, if the transmitted claims file contains 10 error lines out of 20 to 99 lines, the entire campaign may be canceled.

3. Failure to reactivate the user's Stripe account within five days of restriction:

 If a user's Stripe account is restricted, the payment link will also be inactive. Consequently, it would be impossible for debtors to make payments. As a result, Respaid reserves the right to pause the campaign. If no updates are made by the creditor after 5 days, the campaign will be canceled by default.

4. Debtor's demonstration that false documents were used by the creditor:

 To maintain the legitimacy of debt collection efforts, documents must be authentic. A report of using false supporting documents can be grounds for cancellation. Our team will contact you to inform you of this.

5. Complaint filed with the mandated Bailiff's Office/Commissioners of Justice based on the representation of a fraudulent service:

 Claims must be liquid, certain, and due. A significant number of complaints for representing a fraudulent service can be a reason for campaign cancellation.

6. Lack of response to disputes or requests for evidence:

 The creditor has 5 business days to respond to disputes or requests for additional documents. Without a response, the case will be canceled. Deliberate delay in handling disputes or invoice requests on multiple cases in a campaign may lead to its cancellation.

7. Non-compliance with the ethical debt collection charter by the creditor:

 We place utmost importance on the creditor's image and the credibility of our actions. To preserve this, we have established an ethical charter - Article 12 of our 

Respaid assumes professional responsibility from the first day of initiating debt collection for a campaign. Given these cancellation reasons, data processing is subject to a fixed fee of 8.7% of the total amount to be recovered.

We prioritize discussion before any cancellation. Therefore, we remain at your disposal for any questions regarding these procedures, in our constant effort to provide a transparent and efficient service.

 Irreversibility of canceled campaigns: It is impossible to reactivate a campaign once canceled, regardless of the reason.

Legitimate reasons for mass cancellation of cases and associated fees

, you can cancel your annual or monthly license anytime. To initiate the license cancellation process, please notify us through one of the following methods:

Via the live chat (on your Respaid dashboard)

By emailing support@respaid.com or billing@respaid.com

By contacting your designated account representative directly

To ensure prompt processing of your request and immediate effective cancellation, we kindly request that you submit your license cancellation notification by registered mail with delivery confirmation, at least 15 business days before your next billing cycle.

Upon receipt of your request, you will maintain access to our services until the end of the current billing period. You must officially inform us of your intention to cancel your subscription so that we can properly adjust our billing and account management processes.

Following Section 3 - 4.3.5. Subscription Plans, in the event of non-payment, the following measures will be applied:

Revocation of preferential pricing terms 6 business days after launch

Suspension of all collection efforts and deactivation of payment links 9 business days after launch

For a "Completed" campaign (all automated notifications sent):

Discontinuation of collection follow-ups and manual case processing

Delayed handling of debtor communications

Restricted payment links that no longer allow debtors to engage with the assigned collections team

In summary, you have the right to cancel your license subscription, provided that you notify the Respaid team at least 15 days before the next billing cycle. Please note that unreported non-payment, regardless of the reason, will result in additional fees and impact the handling of your collections cases. Therefore, we strongly recommend informing us of any intention to cancel your license to avoid additional charges and ensure seamless continuity of your case management.
